What's with the new nazi stance on live streaming posts? Does the kennel think they are solving piracy or have they received warnings because of the live streaming thread? It wouldn't be too hard to get a thread going where people can exchange links via PM and post requests. That should have no problems regarding warnings, etc. Unless of course the mods randomly decided it was immoral to share live streaming links in the best interests of fox sports, in which case I strongly disagree. Please explain mods.

wigum unfortunately it just is what it is, tk is run basically by volunteers and unless you have some serious coin you want to throw around to try and do what even optus couldn't just use google and find what your looking for there

Basically a complaint was made, so any links to live streaming sites will be deleted and the poster infracted.
It's just the way it has to be.

Hey Wigum,

It was a question bound to be asked, and whilst I am no lawyer, here is what we found out.

In the eyes of the law, there are two main things:
1. Directly infringing copyright (e.g providing a stream to others).
2. Encouraging copyright infringement (e.g providing a link to a stream, alluding to a stream, etc etc).

Both will have you in court answering to the powers that be.

In addition I can confirm that both the NRL and Fox Sports lawyers do regular spot checks on supporters forums.

Hope this clarifies the new stance on this (which BTW came right from the top at The Kennel).

Negative .. Anything comment that encourages copyright infringement, or a user to seek out such sites will gain an infraction.

The problem is that if something is infringed the site gets in trouble, and Fox will ask for the users details to take the matter furthur.

How Google get around it, hmm that is a good question. I guess their arguement would be much like any other illegal search result, they just provide the search engine, the person searching for live streams is the person encouraging infringement of copyright.

There is a provision under Australian Copyright Law for "inciting/encouraging breach of copyright", which is what posting stream links falls under.

Whilst the link itself may only be text, the fact it is inticing/encouraging the breach of copyrighted material, and the penalties are as strict as a direct breach.

The Kennel is transparent in all this, as there are no Freedom of Speech laws in Australia. If Fox Sports spot a link, they don't go after The Kennel, they go after the person posting the link.

Their lawyers contact the relevant people on this site, naturally the site has to comply to any legal demands, and pass on users details. From there they'll contact your ISP, get all the info they need, then consider prosecution, a civil case against the user, or issue a cease and desist to the user.

In short, links get deleted, and infractions are made on behalf of the site to save the users backside, and prevent the site from any potential liability..
