well this is what I don't get, I got married to my wife cos basically I could NOT have kids with her (or have sex) without getting married AS PER MY RELIGIOUS BELIEFS , there was no other reason I got married to her.

So it goes back to the same argument that marriage between a man and a woman (not man with man or woman with woman) has always been a religious act or a compulsion from religion (all religions not just one) to keep people away from sin. period.

I feel like a broken record as the question has been asked on these forums and else where , homosexuality is not accepted by any of the main religions on this planet, why would gay want to get married , when they have all the rights and freedom in this country to do every thing they want that also includes living together, having sexual relation ship and even have kid.

It is like a person like me who practices islam but because he doesn't feel equal to christians in this country he wants to get married with 4 women at the same time in a catholic church by a catholic priest and taking the vows as per the bible.

Or even better I want to get divorced by catholic church just cos I want to feel equal to my Christian brothers in this country.

you didn't get my last statements or found them ridiculous cos you don't understand that marriage is a religious act, always has been and always will be.

if you think marriage predates all religion than prove it to me according to what belief system marriage was a compulsory act to have sexual intercourse or have kids at any point in human history.

and for your argument that gay couples have to provide evidence of their relationship with documented evidences that they have been living together and in a genuine relationship etc then I had to do the same when I brought my mail order bride from overseas to prove my relationship with her. I got married overseas and never got any piece of paper from Australian govt or institution to show that me and wife were married.

whats the big deal here?

He did answer your question. Love starts and stops with reciprocation and respect. The same way a consenting act of sex could be construed as an act of love, but a case of someone drugging someone and keeping them captive in the basement wouldn’t be.

We don’t stand against marriage as a society to discourage people from drugging others and keeping them captive in their basements.

Your argument is a diversionary one and it’s hurtful for consenting adults to have their relationships compared to instances of abuse where manipulation and control is a major part of that power dynamic.

I really don’t get how people don’t see this.

How does the law define a de facto relationship?
The laws defining a de facto relationship are outlined in the Family Law Act. The law requires that two people, who may be of the same or opposite sex, have a relationship as a couple living together on a genuine domestic basis. However, a relationship is not a de facto relationship if the couple is legally married to one another or if they are related by family.

There are four “gateway” criteria that are used to assess whether a claim for property settlement or maintenance can be made in respect of the relationship when it comes to Family Law matters:

  1. That the period of the de facto relationship is at least 2 years;
  2. That there is a child of the de facto relationship;
  3. That the relationship is or was registered under a prescribed law of a State or Territory.
  4. That significant contributions were being made by one party and the failure to make an order would result in a serious injustice.
For any relationship that ended after March 2009, and which meets at least one of the four “gateway” requirements for de facto relationships, parties are able to commence proceedings in the Family Court or the Federal Circuit Court. The Courts will then deal with the matter in a very similar way they would with a legally married couple commencing proceedings.

For individuals who are considering entering into a de facto relationship by moving in together, or who have moved in together, it is important to understand the implications of such an arrangement. It is worthwhile to discuss matters with your partner or consider a more formal Binding Financial Agreement (or “pre-nup”) which is available to de facto couples as well as married couples and provides greater certainty when it comes to the division of assets in the event of a relationship breakdown. An Accredited Family Law specialist can assist you in deciding whether a Financial Agreement is right for you.

What am I entitled to if my de facto relationship breaks down?
If your de facto relationship comes to an end, you have up to two years to apply for financial orders (property settlement). If you seek to apply after this two year period, you will need to first obtain the Court’s permission.

You should seek advice from an experienced lawyer as to your particular entitlements in the circumstances of your relationship as there is no one answer as to the appropriate outcome. Learn more about de facto property settlement.

You will have access to the same legal systems as a legally married couple and can apply for various types of court orders including parenting, child support, maintenance and the division of assets, including superannuation. As with separating married couples, de facto couples can come to an agreement outside of the court system through alternative dispute resolution.

don't tell me about the bias and prejudice I go through with govt and general public on daily basis and the criteria to prove I am not an extremist. the amount of time I go through bomb detection security checks at the airports and they still ask me the question "have you gone through this test before"... I am like yeah fucken this morning. so again , I am not throwing the victim card here , just telling you how this world operates and what is the law.

also read your posts on last 2 pages and see the hypocrisy and prejudice in your own posts. lol

I already told you the steps I had to go through to prove me wife I legally wed to in another country is actually my wife.
