Parramatta Eels salary cap scandal: 'Gang of five' lose bid to have suspensions lifted

Five Parramatta Eels officials who took the NRL to court after their registrations were suspended following alleged salary cap rorting have lost their bid to have the suspensions declared invalid.

Eels directors Steven Sharp, Tom Issa, Peter Serrao as well as chief executive John Boulous and general manager of football Daniel Anderson have until tomorrow to show cause why they shouldn't be permanently deregistered following a breach notice served on May 3.

The club has until Friday to answer the 64-page breach notice. The NRL has said sanctions available to it include docking competition points and a $1 million fine.


The so-called "gang of five" challenged their interim suspension on the basis that the NRL was obliged, as a matter of procedural fairness and natural justice, to give them notice of the suspension and the opportunity to be heard.

But Justice James Stevenson rejected that argument and found the NRL's rules did not oblige the governing body to afford the officials such an opportunity.

Following an investigation into alleged salary cap breaches that had been going on "for some time", NRL chief executive Todd Greenberg decided the five men had broken the NRL rules and were not fit and proper to remain registered club officials.

He notified the men of their suspension in writing three hours before holding a media conference. The notice gave them five business says to show cause why their registration should not be cancelled. That deadline was eventually extended to just over a month.

The plaintiff's barrister Arthur Moses SC argued the men had been, in effect, subjected to a "public flogging" and the loss of their registration would result in serious consequences for their "livelihoods and reputations".

But in a written judgment Justice Stevenson said: "On the proper construction of the rules, the plaintiffs did not have any right to be heard before the NRL made the suspension statement or issued the notices.

"The notices are valid".

After receiving their responses to the show cause notices, Mr Greenberg is empowered under the NRL rules to issue a caution, commence breach proceedings, suspend registration for a period of time or cancel their registrations.

The men can challenge Mr Greenberg's decision by appealing to the NRL Appeals Committee.

On Tuesday the NRL told the court it would be seeking costs.

So they lose their points today?
No apparently that will happen in two weeks time when the NRL has fully read the response.


Should not have been that difficult really, all Parramatta had to say was " Yes we did it"

Now the police are involved investigating the possibility of fraud.

The thing that I don't get is the insistence in this and other articles that it is a case of "IF" they lose the points. The punishment mooted back in May was a provisional one subject to the response.

NSW Police have confirmed they have commenced an investigation into the Parramatta Eels after a review of the NRL's report into salary-cap breaches.

The Fraud and Cybercrime Squad is leading investigations.

It is understood the Fraud Squad has a copy of the breach notice issued to the Eels and is set to focus on alleged false invoices that were uncovered as part of the initial investigation.

The ABC understands Fraud Squad detectives were at the Parramatta Leagues Club today and their investigation is ongoing.

In May, the NRL sought to fine the Eels $1 million and dock the team 12 competition points in its preliminary findings after uncovering cap breaches dating back to 2013.

Five club officials — chairman Steve Sharp, deputy chairman Tom Issa, director Peter Serrao, chief executive John Boulous, football manager Daniel Anderson — were also asked to show cause why their registrations should not be cancelled.

The officials took the league to court over the attempt to deregister them, but the Supreme Court ultimately dismissed proceedings on Tuesday.

The club has until Friday to show why the financial and points punishments should not be handed down.

In order to play for points through the final 15 rounds, the Eels' 2016 squad had to become compliant and did so before round 10 by shipping hooker Nathan Peats to the Gold Coast and seeing Anthony Watmough retire due to injury.

Since then, the Eels have won one of the three games they have played, with two more competition points coming from a bye in round 13.

The official ladder on the NRL's website has the Eels sitting in fifth spot on 16 points, but they will tumble down to second-last, ahead of Newcastle (three points), if they lose the 12 points they earned through the first nine rounds of the season when the team was over the cap.

Should come as no shock the Eels management would try to protect their jobs with a legal challenge, who wouldn't really? That shouldn't have had any effect on a punishment for a cap breach, that has nothing to do with the law, its just a rule within a game.

Instead, by dragging it out like they have, its still being reported on today. Deregister the management, don't deregister them..... don't see how that is preventing the NRL from ending the only part most fans would actually care about, which is the points, or anything that effects the on field side of things.

Poorly handled by the NRL I think, if I was a Eels fan, I'd be so angry. I remember when we had our cap issue, it was shattering, but, it happened, then we could work on getting over it.... it wasn't just hanging there for more than a year over our heads as fans, waiting to see what happened. The Eels management get whatever they get, but I do feel a little for Eels fans that have had this dragging out, like the worlds slowest band aid being pulled.

We're already half way through the season, doesn't seem like there has been any advancements regarding their points.

NRL are hoping everyone forgets and by time finals ome they won't be able to do a thing about it.

Likewise they'll open the war chest and introduce the marquee player allowance so that Parra (with NRL paying part his wage), will get Hayne back.

Can someone explain why these guys still have their CP?
It's not fair to fringe teams trying to fight for a top 8 spot!

I think teams that cheat the cap should be forced to forfeit the season.

Don't you just love how they took the 37 points off us straight away booting us down the ladder, yet the same thing happens to another club and they have a chance to reply and do whatever shit they're doing. We didn't even get that chance.

there will be a decision made in August and
Parra will also make the finals like I was told .. All going to plan

NRL administration were aware of salary issues during 2015, handed a suspended fine/docking of 2016 points...nothing done by Parramatta, in fact, quite the opposite....SPENDING SPREE !!!
Now, they also have $500k+ in guaranteed TPA for 2017 and STILL have all their win points and for/against for 2016
No mention of the docked 4 points to start 2016
(although they did shed a couple of players, which I guess makes everything ok)
Beyond a joke!

This is what will happen


Parramatta will be:

-stripped of all points
-parramatta will then legally appeal the punishment within the 28 day period
-this will drag on till August
-the nrl will then grant their points back
-parra will field their A Grade team with the inside knowledge that they will make the finals
This info was given to me on the eve of the decision and so far its going to plan
