Everyone may recall that there was a supression order (initially) on the George Pell case, to allow a fair trial.

During that supression order members of the Australian media were not allow to mention or report on any details surrounding the case, to avoid influencing the sentencing/jury.

DO NOT DISCUSS THE PELL SITUATION OF GUILT/NO GUILT IN THIS THREAD.

This thread is purely to discuss the contents of the article below, stating that several journos may be facing prison time for contempt of court (including some big names).

https://www.theage.com.au/national/...ports-after-pell-verdict-20190326-p517qf.html

Dozens of Australia's leading media editors and journalists, including staff at The Age, could face prison for contempt of court over allegations they breached a suppression order in reports published after George Pell's conviction on child sex abuse charges.

Victoria's Director of Public Prosecutions, Kerri Judd, QC, has named 36 organisations and individuals in a motion before the Supreme Court and applied that they be found guilty, convicted and either imprisoned or fined.

Editors of:
  • The Age
  • The Herald Sun
  • The Sydney Morning Herald
  • Sydney's Daily Telegraph
  • Australian Financial Review
are all named in the motion.

The Age and its owner, Nine Entertainment, The Herald and Weekly Times and Nationwide News, the publisher of The Daily Telegraph, are among the organisations in the motion.

The editors, journalists and their employers were issued with summons notices for contempt of court relating to stories that were published in December last year, after Pell was found guilty of sexually abusing two choirboys.

Australian media were prevented from naming Pell in reports last year due to a suppression order, which was put in place to ensure Pell received a fair subsequent trial on other allegations.

County Court Chief Judge Peter Kidd lifted the suppression order in February, when prosecutors confirmed the second trial wouldn't go ahead. Judge Kidd's ruling then allowed media to report Pell's guilt and details of the trial.

Pell, 77, was last month jailed for six years. His appeal against conviction will be heard in early June.

Australian media were put on notice by the OPP in the days after Pell was found guilty, over reports that broadly referred to the case but didn't name the Cardinal. International media that reported Pell's guilt at the time, among them The Washington Post and The New York Post are not facing charges.

On December 13, two days after Pell was found guilty, The Age published a front-page story under the headline "Why media can't report on a high-profile case". The Age Editor Alex Lavelle, with afternoon News Editor Patrick O'Neil and Investigations Editor Michael Bachelard – who co-wrote the story – are among those cited for contempt.

In documents released on Tuesday by the Supreme Court, the OPP alleges the media organisations and individuals prejudiced and interfered with "due administration of justice in the prosecution of Pell", "aided and abetted overseas media's contempt", and that their publishing "had the effect of scandalising the court".

Prosecutors have applied for the organisations and individuals to be found guilty, to be convicted and to face either jail terms or fines.

Justice John Dixon will hear the application on April 15.

The 36 respondents are:

  • The Herald and Weekly Times Pty Ltd
  • Damon Johnston
  • Charis Chang
  • News Life Media Pty Ltd

in an era where we get news from sources all over the world, suppression orders do tend to have weakened effect.

Bad news for Chris Smith ahead of his first game for us in 2019. Hope he can ignore it and rip in on the field.

That’s quite a long list. I doubt any of them will do time.

Don't be too sure.

Derryn Hinch has been convicted three times for contempt of court for breaching supression orders. Jailed twice and home detention for a third. One was 2 weeks behind bars, the other 50 days, and a third home detention.

Like Johnny Rotten used to say, the Press is the enemy of the world.
Sure people like Derryn Hinch go to jail with their heart in the right place but you have to let the courts do their job, go through the process, let justice do its thing to make sure there is no mistakes and the correct level of punishment dished out.

Courts to issue justice? Unheard of. The media is judge, jury and executioner. Guilty or innocent is not the point, whatever sells or gets more clicks is correct.

This is different to free speech bro but I know they will try and claim free speech whilst writing articles demonising people having free speech in actual circumstances where there’s no supresssion orders etc where it’s not about free speech anymore.

Hinch tried... he copped it.

DPP has a very dim view of people disobeying court directions.
Have I read this correctly that these “journalists” broke a court order (nothing to do with free speech which they’ll claim) which could have easily swayed public opinion or ruined that potential second trial for a different case?

they didn't break a court order, they loosely alluded to it and the court is being petty

Mate most of the media have their favourites as well as their pet hates, obviously the the Catholic church has its detracts just like our Bulldogs. Journos will pursue their agenda weather for profit or just to re-enforce their prejudices. Put more clearly, they will either feed you what you want to here or or what you don't want to here.

It is not biased at all, courts have done this kind of thing before when there are multiple cases involving the same person and or there is a high media interest in the story. One big example i can think of was the gangland killings down in melbourne, the underbelly series had to leave stuff out because there was ongoing cases involved and there were suppression orders in place.

They did.

They weren't allowed to mention anything about the case.
