Like the OJ Simpson case.

Found not guilty in a criminal trial, but found liable in a civil
Which of course ol’ Orenthal never paid the damages of - maybe a fraction - hence my point of good money after bad. Some parties should see their ‘moral’ victory as just that and forget any dollar signs that might be in their eyes. It’s not just defo - I’ve seen court cases time and time again that end up delivering almost nothing. The lawyers are the only ones who get rich…

A "defo" case with a difference, this time it is against Ch 7, instead of driven by them...

His photo wasn't published

The name appeared on the Seven website, on its YouTube channel and on-air on Sunrise. No images of Mr Cohen were broadcast or published.

7 will surely want to settle this ASAP. How the fuck did they get that one so wrong?

How does a student hire any sort of Barrister let alone a SC? Doesn’t add up unless someone else is writing the cheques. No lawyer at that level works for free and not even on a ‘pay me if you win’ basis. Reckon this one will get settled quickly and quietly but this highlights a major problem today - in an effort to be ‘first’ - so much misinformation gets published but people are happy to spread it and not care about the consequences. A bit of a shit go all round.

It's called acting on a speculative basis (or to put it in the terms compo lawyers use: no woinn, no fee). Most legal actions i run are done in this manner.

Be good chances of recovery, plus high profile case for the barrister (see free advertising). Most lawyers would jump at a case like this.

For compo lawyers absolutely, but as I said above not for SC’s and that was my point - they neither need advertising nor do work for free, even up front. So someone is writing cheques to get the process started.

A 3rd party might be covering costs, but definitely it's not a given. PLENTY of SCs would take a matter like this on spec, especially in this space. They can charge uplift on their daily rate, strong case and no risk the respondent cant pay. In any case, the matter hasn't been filed, and its unlikely they've actually done an ounce of work on the file yet, and simply scored free publicity so far

Yeah, that part is true - an instructing solicitor would be the gofer at this point - depends on how far the matter proceeds I guess. Seven might be over the litigation at this point and offer a settlement early on. We’ll see.

It has been left open for an appeal. Several mistakes in the judgement.
Yes assume an appeal. There almost always is. But where is the money for that?

We all know the truth of that one as well in the court of public opinion :grinning:
