I thought defence teams werent allowed to use previous incidents as a reference point? Or is it that they just cannot use examples of when a player has been found not guilty to basically say "this player got off this charge so my client must be not guilty also"? Then again the incompetent shitsniffers at NRL HQ make up the rules as they go so anything is possible.The MRC has been a joke for a very long time. From what I understand of his defence, his lawyer presented a whole raft of grade 1 dangerous contact charges that were (to the naked eye) worse than the Sam Burgess one. They've built a rod for their own back by getting the grading wrong almost every single time. This was bound to happen eventually. Hopefully it will lead to a complete overhaul of the system, because its pretty clear the current one is hopelessly broken.
As I understand it you can't use previous examples to get off a charge, but you can use them to get a charge downgraded (in this case from grade 2 to grade 1). This is where a smart solicitor will take advantage of the system. By using previous examples of a grade 1 which were demonstrably worse a good brief can mount a pretty damn good case to get his client off. It all comes back to the system being broken...if they'd graded those previous examples correctly in the first place then there would be no reference point for the lawyer to use.I thought defence teams werent allowed to use previous incidents as a reference point?
