John Hopoate not a licensed security guard when working at Kings Cross club

POLICE are investigating why former rugby league bad boy and boxer John Hopoate was not licensed to work as a security guard when he allegedly chased and bashed a man he'd rejected from a well-known Kings Cross hotel.
Hopoate and the Trademark Hotel, a nightclub associated with John Ibrahim that is part-owned by radio shock jock Kyle Sandilands, could face fines of up to $110,000 and $55,000 respectively if criminal action is taken and a licence breach is proven.

Individuals employed and operating as security guards who are not properly qualified and licensed can also be jailed for up to two years.

Hopoate, 36, was last week charged with assault occasioning actual bodily harm and affray after allegedly chasing and punching a 27-year-old man he had refused to allow enter the hotel last Saturday.

The victim's 33-year-old brother was seriously injured in the altercation, but no one has been charged over this aspect of the melee.

He remains in St Vincent's hospital in a serious but stable condition after undergoing neurosurgery following his admission last Saturday night after the 11pm incident.

Police Deputy Commissioner Dave Owens told The Sunday Telegraph that part of the investigation was determining who precisely employed Hopoate, the Trademark Hotel or their security subcontractor, and in what capacity he was employed.

"We are investigating all aspects of the licensed premises. Part of the investigation is to find out what function and role he [Hopoate] was fulfilling at the time of the alleged assault," Mr Owens said.

If criminal charges are not pursued over any alleged licence breach, police can issue a penalty notice, with fines of up to $11,000 for a corporation and $5500 for an individual unlicensed guard performing security work.

Asked on Friday whether he would talk about his security licence, Hopoate said: "Yeah, what about it?"

When The Sunday Telegraph said: "I understand you don't have one. Were you working as a security guard at the Trademark Hotel last Saturday night?", Hopoate promptly hung up the phone.

His lawyer Stephen Alexander said: "The matter is before the courts and it's inappropriate for us to say anything. My client is doing well, under the circumstances."The Sunday Telegraph understands Hopoate, a father of nine, was operating as an RSA (Responsible Service of Alcohol) marshal at the Trademark Hotel, which is also the location of the upmarket cocktail bar, the Piano Room.

Hopoate is understood to have been employed in the hospitality industry in this "customer relations" capacity for a number of years.

It is unclear whether he holds an RSA certificate as the Office of Liquor Gaming and Racing does not keep records of individuals who have obtained such a qualification.

An OLGR spokesman said the sole responsibility of an RSA marshal was to observe patron behaviour and consumption levels.



Hopoate is due to appear in Downing Centre Local Court on January 11, 2011

i hope he gets screwed over for this,typical islander and no surprise that the ibrahims dont comply with the law allowing him to work unlicenced
