It was not in place yet they claimed De Bellin was stood down and could not play matches.

EMBARRASSMENT of an organisation. Court determined that there was no rule in place so De Bellin is free to play... unless the NRLol rush in the new rule changes.

JDB is a piece of shit for cheating on his wife who is pregnant with his kid but he didn't break any law if the other woman agreed to it. You can't just suspend someone if they didn't commit a crime. It could cost him 200k from lost Origin and international payments.

St George Illawarra Dragons player Jack de Belin is taking the NRL to court over his playing ban.
The judge presiding over Dragons star Jack de Belin’s Federal Court bid to overturn his ban says the forward will be free to play round one unless the NRL enacts it’s ‘no fault’ policy.

De Belin claims he wasn’t validly suspended by the NRL after being charged with rape, contending the league engaged in misleading and deceptive conduct.

The 27-year-old’s matter was heard in court on Thursday for a preliminary hearing.


Justice Stephen Rares said NRL material had suggested de Belin had been stood down when in fact he had not.

“There is no entitlement to stand him down from what you have told me,” he said.

“The truth is, nothing is in place at the moment. It is damaging to him as a professional and as an individual.”

The case was adjourned to March 12 by which time the new rule may be in place.

Alan Sullivan QC, for the NRL and the Australian Rugby League Commission, said the proposed new rule and policy to stand down players charged with a serious criminal offence had not yet been enacted.

“There’s nothing to stop him playing rugby league from (between) now and the time the rule is enacted,” he said on Thursday.

NRL chief executive Todd Greenberg said on Thursday the league will have rules in place to stand down Jack de Belin within the next 48 hours, after admitting it had yet to enact its own edict.

“The commission endorsed a policy decision last week. We then need to write the rule, that will be done in the next 48 hours and from there we let the courts make their decision,” Greenberg said.

Sullivan told the court he expects the policy will be in effect before the Dragons’ opening clash against the Cowboys on Saturday week.


In documents filed with the court, de Belin states the bodies did not have the power to suspend him on full pay on February 28, purportedly under a new rule allowing players charged with a serious criminal offence to be stood down so they can’t take part in the NRL competition.


De Belin and Callan Sinclair, 21, have pleaded not guilty to raping a 19-year- old woman in Wollongong on December 9 and are due back in court on April 17.

De Belin claims the NRL and ARLC engaged in misleading or deceptive conduct by claiming they had the power to suspend him and by making a number of public comments.

They include suggesting they had “formed a view that de Belin was guilty” of the rape and had “engaged in conduct that warranted his immediate suspension as a player for the club”.

“The suspension representation was made in press releases, social media, on www.nrl.com, in television, radio and newspaper interviews by Peter Beattie and Todd Greenberg published in every state and territory of Australia,” the court documents state.

The judge also reprimanded Beattie, a former politician, in his handling of the standing down.

“It’s not as though Mr Beattie is not an experienced man with words,” he said.

“It is suggesting that this player has been stood down and he hasn’t… that would be pretty damaging for anybody.”

The player says this caused irreparable damage to his reputation and financial loss.

He is seeking an order that the NRL and ARLC immediately issue a press release and place corrective advertising in numerous newspapers stating: “The NRL has not suspended St George Illawarra player Jack de Belin. He is available to play for St George Illawarra”.


De Belin is seeking damages, compensation and legal costs, as well as a string of court declarations including that the two bodies engaged in misleading or deceptive conduct and unconscionable conduct.

He also wants an order permanently restraining them from inserting the new rule into the NRL Rules or NRL Code of Conduct, claiming it is unreasonable and contrary to public policy.

Under the old policy, players who pleaded not guilty to serious charges were allowed to continue playing until their case was finalised in court.

His lawyers say neither body had any material to enable them to determine de Belin was guilty of rape or in breach of the NRL Code of Conduct.

But for the “threatened suspension”, de Belin intends playing in the first 2019 match on March 16 and in matches through the year and 2020, and to make himself available for representative selection including for State of Origin, the documents state.

This is the sort of fuck up from Greenberg (and subsequent grandstanding) that may see him removed from the job.

Suddenly Dylan Walker, Tyrone May and anyone else suspended is free to play because the policy is not currently active.

I mean sure, the loophole now is for the NRL to create and enact the policy, and then stand them down, but fuck that's embarassing for Greenberg, and the entire NRL.

I think there was a law broken though that it was sexual assault. But I agree that innocent until proven guilty should apply.

Todd needs to go.

The man is still innocent until proven guilty. When did this simple philosophy become completely ignored?

I wish both the NRL and St George Bank luck if he's proven innocent. I'll have a lot more respect for the Dragons if they continue to stand by him until proven guilty.

Greenturd trying to run the NRL like its the wild west.. Good on DeBelin for taking this to court. I wouldve done exactly the same thing in his situation.

As far as cheating on his wife ..no-one here should be judging him, apart from that it's also irrelevant to sport.

By standing him down the NRL has made him appear guilty and also someone not to be associated with which is now being shown by the st George bank saying if he plays we are gone! And want no link with him... Umm your meant to be innocent until proven guilty so how can you demand a currently innocent person be stood down??

I think this will also strengthen his case against the NRL for damages

I think De bellins solicitors are too smart for the nrl, seems like the nrl have got half wits for solicitors

People commenting need to remember that the NRL Integrity Unit (and ARL) are party to details of this case that the public are not. Quite often they interview victims of the accused. The head of the NRL IU is an ex female detective who is highly skilled and regarded in professional circles.

They will have far more information than you, me, or any jouro has on this case (on par with legal teams and police).

Hence I'd be siding with the NRLs decision on this one.

A very valid point often overlooked in these instances.

Not to mention if De Belin is successful, it'll cost the NRL some potential $500-600k in legal fees, which will all be due to Greenberg and Beattie talking the talk before they wallked the walk.

Jack de Belin's fight to clear his name in court could cost him close to his annual $600,000 salary should it ultimately prove unsuccessful.

A Federal Court judge on Thursday declared de Belin free to play, for now, as the NRL had not yet tendered the necessary paperwork to properly enforce the new no-fault stand-down policy for players charged with serious offences.

The NRL will officially submit the paperwork on Monday, with a decision to be made on the legitimacy of League Central's case at an interlocutory hearing next Thursday, the same day the NRL season kicks off.

Sources with knowledge of the de Belin case have told the Herald the 27-year-old will have racked up at least $100,000 in legal bills by that point.

The NSW Origin back-rower has engaged barrister Martin Einfeld, QC, who is understood to fetch a fee just shy of $10,000 per day.

His solicitor, Robert Tassell, is understood to carry a fee of about $4500 per day

On the NRL's legal team, sources say top QC Allan Sullivan charges about $15,000 per day, with solicitor Tony O'Reilly also charging about $4500 per day.

The $100,000 figure will then increase by $50,000 to $75,000 in costs if a judge finds in favour of the NRL and ARL Commission.

But that may only be the start of the real financial pain.

The full extent of that will come if de Belin and his legal team appeal and the case proceeds to a final hearing.

With another two full days of preparation and an additional day in court, one legal source said the $100,000 in costs would quickly hit the $300,000 mark.

If unsuccessful in the final hearing, de Belin would once again have to pay a large percentage of the NRL and ARLC costs, taking the total estimated bill to almost $500,000.

That is quite the price to pay, especially considering de Belin is footing the entire bill by himself.

The Herald has been told the Dragons were considering joining de Belin in taking legal action as late as last weekend but did not do so when the size of the potential bill was floated.

The club continues to support de Belin and pay him his salary but aren't financially backing his Federal Court challenge.

Suspended St George Illawarra forward Jack De Belin has withdrawn his interim injunction to allow him to play this weekend in the opening round of the NRL.
The court case scheduled for Thursday will not proceed in a huge relief for the NRL on the day it launches the 2019 season when the Broncos travel to Melbourne to play Storm.
There had been fears the court case would ruin the season opener.
Instead a full hearing challenging the NRL’s newly introducted No Fault Stand Down Rule will take place in the Federal court on April 16. De Belin will not play in the meantime.
“In the interim the No Fault Stand Down Rule will continue to apply to Jack de Belin and he will be stood down during this period,” the NRL said in a statement on Tuesday.

Hey @Kaz .. Not really de belin crumbling .. it was on the back of the NRL enacted/implementing the new rule; de belin's first case was on the basis there was no rule. it's a moot point.
He is back in court mid-April to argue the authenticity of or NRL's jurisdiction to create the new rule.

That was my understanding.
